We are RTS Management, Inc. and its affiliate E-Sports Evolution, LLC (collectively, “Evo”, “we”, “us”, “our”). By accessing or using Evo Fantasy presented by AT&T (the “Service”), you agree, without limitation or qualification, to be bound by these terms and conditions ("Terms"), as well as the evo.gg Terms of Use (available at https://evo.gg/terms-of-service) and Privacy Policy (available at https://evo.gg/privacy-policy) and/or the applicable policies of the host site, each incorporated herein by reference. If you do not agree, do not access or use the Service. The Service may be hosted, operated, and/or technically supported by Upsets, LLC (“Upsets”). Your use of any Upsets-operated platform or infrastructure may also be subject to Upsets’ Terms of Use and Privacy Policy (available at [URL]).

1. How To Participate

To participate you must be an attendee at Evo Las Vegas 2026. Sign in or create an Upsets account using Discord to unlock the Service.

2. Use of the Service

The Service is only open to US residents over the age of 18. By using the Service, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service. In the event of prizing related to the Service, you agree to accept such prize (as awarded) and acknowledge that the prize is subject to all of the terms, conditions, restrictions, and limitations herein and in connection therewith. You may use the Service only for lawful purposes. You may not misuse the Service, interfere with its operation, attempt to gain unauthorized access, use bots or automated means to access the site, reverse engineer any portion of the site, scrape it without permission, or submit anything unlawful, harmful, infringing, or misleading. Any violation of these Terms may result in immediate termination of your access to the Service. 3. Third-Party Content and Sites

The site may link to, display, mirror, or reference third-party websites, data, content, events, players, teams, games, logos, trademarks, or other materials. We do not own or control third-party content and are not responsible for third-party sites, materials, accuracy, availability, actions, or policies. Inclusion of any link or reference does not imply our endorsement or affiliation. Any transactions, communications, or disputes between you and any third party are solely between you and that third party, and we shall have no liability or obligation with respect thereto. Your access to any third-party site is at your own risk and subject to that site's terms and policies.

4. Rights

If you submit, upload, send, post, or otherwise provide any content, information, name, image, likeness, handle, username, biography, statistics, media, or other material, you represent and warrant that you have all rights needed to do so and that such material does not infringe or violate the rights of any third party. You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, host, store, copy, modify, display, publish, distribute, promote, and create derivative works from anything you submit, including any name, image, likeness, username, profile information, or related rights, in connection with Evo and/or its events. Use of the Service does not give you any right, title or interest in any of copyrights, trademarks, logos, likenesses, or any other intellectual property depicted within the Service or belonging to Evo. You agree that you will comply with all applicable laws, rules and regulations and will not violate the rights of any third party. All trademarks, service marks, and trade names displayed on the Service are the property of their respective owners. All rights not expressly granted herein are reserved. You may not copy, modify, distribute, sell, or exploit the Service or any of its content without permission.

5. Waivers and Disclaimers

We accept no responsibility for system errors or other issues that may result in disruption to, lost, delayed, misdirected, or incorrect metrics. RTS Management, Inc., E-Sports Evolution, LLC, Upsets, LLC, AT&T Services, Inc. and their respective officers, directors, employees, agents, sponsors, and affiliates (collectively, the "Released Parties") are not responsible for the non-inclusion of such actions as a result of technical failures or otherwise, including any such failure which is within the control of the Released Parties.

We reserve the right to cancel, amend, withdraw, terminate, or temporarily suspend the Service for any reason or in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any participants or third parties but will use all reasonable endeavors to avoid participant disappointment.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR ANY DATA, STATISTICS, SCORES, OR RESULTS DISPLAYED THEREIN WILL BE ACCURATE, COMPLETE, CURRENT, AVAILABLE, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

6. Disputes.

You agree that to the extent permitted by applicable law: (a) any and all disputes, claims and causes of action arising out of or connected with the Service, or any prize received, will be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; (c) under no circumstances will you be permitted to obtain any award for, and you hereby knowingly and expressly waive all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out of pocket expenses not to exceed ten dollars ($10.00), and/or any rights to have damages multiplied or otherwise increased; and (d) your remedies are limited to a claim for money damages (if any) and you irrevocably waive any right to seek injunctive or equitable relief.

7. Indemnification.

You agree to indemnify, defend, and hold harmless the Released Parties and their respective officers, directors, employees, agents, sponsors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) anything you submit through the Service.

8. General Provisions.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with any other policies referenced herein, constitute the entire agreement between you and us regarding the Service. We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.

9. Changes

We may update these Terms at any time by posting the revised Terms on the Service platform. Continued use of the Service after any such changes constitutes your acceptance of the updated Terms.
